By accessing or using RoachMyEx.com ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you don't agree to these Terms, please don't use our Service (but your ex probably still deserves a roach).

2. Description of Service

Roach My Ex is a novelty revenge gift service that allows users to anonymously send preserved cockroaches to addresses they provide. This service is intended as:

• A harmless prank
• A therapeutic closure mechanism
• A novelty gift service
• A legal form of expression

This is NOT intended for harassment, stalking, or illegal purposes.

3. Eligibility

You must be:

• At least 18 years old
• Legally able to enter into binding contracts
• Using the Service for legal purposes only
• Not violating any restraining orders or harassment laws

4. Prohibited Uses

You may NOT use our Service for:

• Harassment or stalking
• Violating restraining orders or court orders
• Targeting protected individuals
• Sending threats or intimidation
• Violating any local, state, or federal laws
• Sending to government officials or businesses
• Targeting children or vulnerable individuals

We reserve the right to refuse service to anyone for any reason.

5. Legal Use Only

Sending preserved insects through USPS is legal when done for novelty or gift purposes. However:

• You are responsible for ensuring your use is legal in your jurisdiction
• You agree not to use our Service in violation of any laws
• You agree the recipient is not protected by restraining orders against you
• You accept full responsibility for your use of the Service

6. Anonymity and Privacy

While we guarantee anonymity of the sender:

• We may disclose information if legally compelled (court order, subpoena)
• We cooperate with law enforcement when required by law
• We reserve the right to refuse service if we suspect illegal activity
• Anonymity does not protect you from illegal activities

7. Orders and Payment

7.1 Order Placement

• All orders must include accurate recipient information
• We are not responsible for errors in address information you provide
• Custom messages must not contain illegal content or threats
• We reserve the right to reject inappropriate messages

7.2 Pricing and Payment

• All prices are in USD
• Payment is processed securely through Stripe
• We do not store credit card information
• Prices are subject to change without notice

7.3 Processing Time

• Orders are typically processed within 24 hours
• Shipping takes 3-5 business days via USPS
• We are not responsible for USPS delays

8. Refund and Cancellation Policy

8.1 Cancellations

• Orders can be cancelled within 2 hours of placement
• After 2 hours, orders cannot be cancelled (already in processing)
• To cancel, email revenge@roachmyex.com immediately

8.2 Refunds

• Due to the nature of our service, all sales are final once shipped
• We offer refunds only if we are unable to fulfill your order
• Damaged roaches will be replaced free of charge
• No refunds for recipient refusal or "changed my mind"

8.3 Lost Packages

• If USPS tracking shows package as lost, we'll send replacement
• Must contact us within 14 days of expected delivery
• Provide tracking number for verification

9. Shipping Restrictions

We currently ship only within the United States. We may refuse shipment to certain addresses or jurisdictions at our discretion.

10. Product Information

Our Roaches:

• All cockroaches are real, ethically sourced, and professionally preserved
• They are completely dead and pose no health risk
• They are safe to handle (though we don't recommend it)
• They cannot come back to life or reproduce
• Quality and size may vary slightly

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, express or implied, including:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Specific results or outcomes

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any indirect, incidental, or consequential damages
• We are not responsible for emotional distress caused to recipients
• We are not responsible for legal consequences of your use
• Our total liability shall not exceed the amount you paid for the service
• We are not responsible for actions taken by recipients

13. Indemnification

You agree to indemnify and hold harmless Roach My Ex, its owners, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any laws
• Any harm caused to third parties

14. Intellectual Property

All content on this website, including:

• Logo, branding, and design
• Text, images, and graphics
• Code and functionality

15. User Conduct

You agree NOT to:

• Hack, disrupt, or interfere with the Service
• Use automated systems (bots) without permission
• Attempt to reverse engineer our systems
• Misuse or abuse customer support
• Create fake accounts or orders
• Violate any applicable laws or regulations

16. Termination

We reserve the right to:

• Refuse service to anyone at any time
• Terminate accounts for Terms violations
• Cancel orders we deem inappropriate or illegal
• Cooperate with law enforcement investigations

17. Governing Law

These Terms are governed by the laws of the State of Michigan, United States, without regard to conflict of law principles.

Venue: Any legal action must be brought in courts located in Wayne County, Michigan.

18. Dispute Resolution

18.1 Informal Resolution

Before filing any claim, you agree to contact us at legal@roachmyex.com to attempt informal resolution.

18.2 Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration in Michigan, except you may bring claims in small claims court.

18.3 Class Action Waiver

You agree to bring claims individually, not as part of a class action.

19. Changes to Terms

We may update these Terms at any time. Changes will be effective immediately upon posting. Continued use after changes constitutes acceptance.

We'll notify you of significant changes via email or website notice.

20. Severability

If any provision of these Terms is found invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full effect.

21. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Roach My Ex regarding use of the Service.
